2006 E85 Legislation Update
“We would hope that if this legislation is approved retailers would pass much of the savings on to the consumer,” said Phil Lampert, Executive Director of the NEVC. “It is imperative that if E85 is to be successful, that the cost is less than unleaded fuel at the pump.”
This tax credit will phase to 20 cents per gallon in 2009-2010 and 10 cents in 2011, after which the credit will no longer be available. Additionally, incentives will be available for biodiesel.
This bill will also require public access to alternative fueling locations that are only open to Federal government fleets. Exemptions will be made for national security purposes.
Obama and Lugar’s legislation will provide automakers with a $100 tax credit that would otherwise be lost through the application of the Alternative Minimum Tax for every FFV produced above the number required under the CAFE fuel mileage incentive.

The IRS will soon be releasing guidelines for retailers to take advantage of the infrastructure tax credit available through the 2005 Energy Bill. Language was released previously, however; the forms restricted credits to a one-per-customer limit on the tax incentives.
The policy will lead to a large increase in the number of E85 refueling sites across the U.S.
“Allowing retailers to obtain this credit for multiple stations is a must for our industry to grow at a rapid rate,” added Lampert. “We are pleased to see the Treasury Department follow this route.”

NEVC Supports Report Regarding Bioenergy Action Plan for California
As with the previous version of the book, the NEVC worked with the U.S. Department of Energy to compile information. “This guidebook is an important tool to inform retailers of the specifics of installing E85 infrastructure,” stated Phil Lampert, Executive Director of the NEVC.
The updated handbook will include details regarding the production, properties, and environmental impacts of E85; E85 specifications and standards; material recommendations; storing and dispensing the product; safety procedures; and much more.

This year already has proven to be a huge success for the Minnesota E85 team! Not only have they opened their 200th E85 refueling location, the group have had other major accomplishments.
"We are very excited here in Minnesota to not only have opened 200 E85 fueling sites, but to have the most locations throughout the country!” Exclaimed Tim Gerlach of the Minnesota E85 Team. “I would like to thank Minnesota Corn, the NEVC and many others for their support in helping to make this milestone happen."
Other accomplishments from the state include: the University of Minnesota receiving the MNGREAT award on February 15th. The award recognizes environmental achievements by government employees, focusing on the prevention of waste and pollution, the reduction of waste at its source, conservation of energy and water, recycling, and composting. The U’s fleet currently has 71 E85 compatible vehicles and uses 20,000 gallons of E85 per year.
Beginning March 15th, theater-goers in Marshall, Minnesota will be introduced to E85 before catching the latest film. Marshall 6 Theater will run the 30 second ad with voice-over on all six screens before every show. Marshall is now home to three E85 retailers.
Belle Prairie Junction BP sold 1,234 gallons of E85 on February 6th. The station sold E85 for 85˘ less than gasoline all day and offered free hot dogs, brats and soda for lunch. An FFV display was provided by Falls GM, Moll Ford and Little Falls Dodge-Chrysler-Jeep and the local radio station broadcast from the event.

NEVC to Sponsor Clean Cities Congress Luncheon
Join alternative fuel and alternative fuel vehicle experts for the Clean Cities Congress and Expo 2006 in Phoenix, Arizona from May 7-10, 2006. Fueling Economic Solutions is both the theme and focal point for this year's Congress and Expo.
The Alternative Fuel Vehicle Institute (AFVI) along with Arizona Clean Cities Coalitions will bring together more than 1,000 transportation leaders from around the country to learn about advanced transportation technologies that are being demonstrated or in use today.
As stated in a statement from Clean Cities Congress, “The focal point of the Clean Cities Congress is to provide independent, market-ready transportation solutions that will contribute to clean air and mobility options that decrease dependence on petroleum. . . The Clean Cities Congress and Expo 2006 marks the first year that industry, government and academia representatives will officially join under the umbrella of an industry sponsored gathering.”
This conference plans to discuss issues relating to the latest regulations, court challenges, and product availability and trends. Attendees will also be able to meet the people who are making it happen. Other events include tours, presentations, a Ride-n-Drive, a vehicle auction, and social events.
The National Ethanol Vehicle Coalition is a Silver Sponsor for this event. Along with hosting a Clean Cities Coordinator luncheon on Tuesday, May 9 at noon, Phil Lampert, Executive Director of the NEVC will address all attendees following the lunch. The session is titled Driving Range: Making Fuel Choices That Will Take You Farther and will focus on the availability of E85.

Legislation to Support E85 in KS
The Kansas legislature has successfully delivered a bill to Governor Kathleen Sebelius, current Chair of the Governors’ Ethanol Coalition, which will decrease the cost of E85 in the state.
This E85 British Thermal Unit (BTU) Equivalency legislation is supported by the Kansas Corn Growers Association (KCGA) along with many other groups. The ruling will reduce the state’s motor fuel tax on E85 from $.24 per gallon to $.17 per gallon. This amount equates for the mileage loss of an average of 12 percent when using E85 compared to regular unleaded gasoline.
“This bill does two things. It addresses an inequity in the state motor fuels tax, and it will encourage the use of E85 fuel,” according to Jere White, Executive Director of KCGA (a member of the NEVC). ”E85 fuel does have a lower energy content than gasoline and a car travels fewer miles on E85 than it does on gas. If a state motor fuel tax is based on a per-gallon fee, the E85 user is being unfairly penalized because he is paying more taxes per mile.”
Kansas is also home to other incentives to support increased E85 availability and consumption. This includes a flexible fuel vehicle (FFV) tax incentive, which allows taxpayers a $750 tax credit for purchasing an FFV and utilizing 500 gallons of E85, along with a state tax credit for infrastructure.

The NEVC welcomes one of our newest members, Agri-Valley. A division of CHS, another member of the NEVC, the organization provides a full range of services such as Energy, Agronomy and Grain.
Agri-Valley joined the NEVC to show our dedication and support of the use of ethanol.
“We support the use of alternative fuels such as Bio-diesel and ethanol to lesson our dependence on foreign oil and to support the ag industry,” said Jeff Schumacher of Agri-Valley. “ We are confident that as more flex-fuel vehicles hit the road, the need for E85 will increase and become more and more popular.”
Schumacher also believes that public education is the key to furthering our efforts. “I believe more people would be using alternative fuels such as E85 and bio-diesel if they had a better understanding of what they are and how they can be used. Broad educational advertising promotions would be beneficial.”
Ethanol Marketing Conference in Omaha
Topics at the conference will include: the renewable fuel standard on national ethanol markets; a review of RFS credits; ethanol marketing strategies; point-of-Sale marketing practices; E85 marketing protocols and partnerships; ethanol standards and quality ensurance; ethanol terminal and transportation options; and marketing trends in 2006 and beyond.
The event will be held at the Sheraton Hotel at 1615 Howard Street in Omaha, Nebraska. Fee for attending the conference is $195 and must be paid in advance via check or money order.
